Legal Procedures

The formalities of buying a property abroad are often what dissuade people from realising their dream of owning a second home in the sun, and understandably so. However, when buying a property in Alanya through 'Homes of Alanya' you can rest assured that you will receive our personal assistance every step of the way, resulting in a smooth and risk free transaction.

The following explains exactly what you can expect when purchasing a property in Turkey:

1) Once you've decided on a suitable property and are ready to go ahead with the transaction, you'll need to open a Turkish bank account. Our staff at 'Homes of Alanya' will be more than happy to assist you with this.

2) You, the buyer, must give 'power of attorney' to 'Homes of Alanya'. This gives the necessary authorisation to the company thus allowing us to proceed with the formalities surrounding the purchase and to offer our extensive post-purchase services.
'Power of attorney' will generally include authorisation to buy/register the property in the name of the buyer; the ability to obtain a 'completion report' for the property; to enable us to arrange for property insurance; register water and electricity meters with the relevant authorities and registration for refuse services as well as registration with the local municipal department and payment of local taxes, etc.

3) A deed called a 'promise to buy and sell contract' between the owner and the buyer of the property will be signed before a Notary Public. This document is official and includes the personal details of both the buyer and seller as well as details of the property price, how payment is to be made, and the time of conveyance at the Land Registry.

In the presence of a Notary Public, a Certified Translator will be sworn to honest translation before proceeding to translate the 'promise to buy and sell contact' to the foreign party. After translation the document will be signed by both parties.

4) As military permission is needed before these procedures can go ahead, an application to the Land Registry will be made. Unfortunately, this process may take several months. Considering that property prices are so reasonable in Alanya, the wait is worth it.

5) On receipt of the military permission, the parties, or their legal representatives (in this case, 'Homes of Alanya') go in person to the Land Registry for conveyance. Again, a Certified Translator is required when one of the parties is a foreign national.

6) You're given the key and deeds to your property and can begin enjoying a long and happy relationship with Turkey and her people.


Expenses

Conveyance tax :

3% of the property value stated in the Tapu Office. The property value stated here is lower than the actual property value. The tax will typically be between 200-500 Euro, approximately. This money is to be paid at a state bank at the time of conveyance.

Translation :

The fee for a certified translator at the Tapu Office will be 50 Euro. As a certified translator is required by law when a foreign national is involved in the exchange of property, this is an unavoidable cost.

The fee for certified translator at Notary Public will be 30 Euro.  

Diverse :

Registration Fee at the Tapu Office: 25 Euro.

Giving Power of Attorney: Approx. 100 Euro.

Signing 'promise to buy and sell contract' at Notary Public Office: Approx. 1.2 % of the value of the property or 350 Euro, whichever is the highest.

Obtaining “Completion Report” (for newly built properties only) : Starting at 350 Euro, this fee depends on the size of the property.

Commission to the Estate Agent: 3 % of the sales sum or 1.000 Euro, whichever is the highest.


Annual Expenses

Property tax :

0.1% of the property value declared by the local authority. This is to be paid before the last day of May each year.

Water :

New connection of water meter : Approx. 60 Euro (once only payment)

Name transfer of an existing connection : Approx. 30 Euro (once only payment)

Water cost per m3 : Approx. 0,75 Euro

Electricity :

New connection of electricity meter : Approx. 100 Euro (once only payment).

Name transfer of an existing connection : Approx. 30 Euro (once only payment).

Energy cost per kwh : Approx. 0,10 Euro.

Land Line :

Telephone connection : Approx. 4 Euro (once only fee).

Cost per unit : Approx. 0.036 Euro.

Monthly rental : Approx. 3.66 Euro.

Unit period (province) : 60 Seconds.

Please note that conveyance is executed at the Land Registry Office. This is a State Department and no other department, authority, company or person has the power to transfer property deeds to your name.

Your ownership deeds will be in Turkish. These deeds are called 'Tapu' in Turkish.
